Expert Witness &
Litigation Consultation
Expert witness and litigation consultation services are available for behavioral health matters involving clinical practice, substance use treatment, mental health care, documentation, treatment planning, supervision, program operations, and standards of care.
Because each matter involves different records, questions, timelines, and levels of participation, fees are determined based on the scope of the engagement.
Services May Include
Services may include record review and case analysis, review of policies and clinical documentation, evaluation of clinical practice in relation to applicable standards of care, consultation with retaining counsel, preparation of written opinions or reports when requested, deposition preparation and testimony, trial preparation and testimony, and other case-related professional consultation.
Fees & Retainer
Expert witness fees are discussed before an engagement is accepted and documented in a written agreement.
Depending on the matter, fees may include an initial retainer or minimum block of professional time, with additional services billed according to the terms of the engagement.
Billable professional time may include record review, research, attorney consultation, preparation, report writing, deposition or testimony, and other work completed in connection with the matter.
Depositions, Testimony & Travel
Depositions, hearings, and trial testimony may be subject to separate minimums, scheduling requirements, cancellation terms, and travel expenses.
Any anticipated travel, lodging, mileage, or other case-related expenses will be discussed in advance whenever possible.
Scope of Engagement
Submitting an inquiry or discussing a potential matter does not create an expert witness or consulting relationship.
An engagement begins only after potential conflicts and relevant case information have been reviewed, the scope of services has been agreed upon, and a written engagement agreement has been completed.
Request Availability
Attorneys seeking expert witness or litigation consultation services are welcome to provide a brief overview of the matter, the type of expertise being requested, relevant deadlines, and anticipated services.
